Terms and Conditions of Sale
1. Preamble and Scope
These Terms and Conditions of Sale (hereinafter referred to as the Terms) apply to all sales made on the website myspicesland.com (hereinafter referred to as the Site) by My Spices Land, a French limited liability company (SARL) with a share capital of EUR 3,000, registered with the Nice Trade and Companies Register (RCS) under number 990 528 275, with its registered office at 1 Rue du Malonat, 06300 Nice, France, represented by its managers Mr. Julien Mattera and Mr. Cedric Valleix.
Placing an order on the Site implies unreserved acceptance of these Terms. My Spices Land reserves the right to amend these Terms at any time; the applicable terms are those in force on the date of the order.
2. Products and Services
The Site offers for sale vanilla, spices, essential oils, natural cosmetic products, and other exceptional food products imported directly from Madagascar. Products are described with the greatest accuracy, but photographs and illustrations are for indicative purposes only.
Product listings are shown on the Site subject to available stock. If a product becomes unavailable after an order is placed, the customer will be notified and may obtain a refund or credit note.
3. Prices and VAT
Prices are shown in euros, all taxes included (TTC). In accordance with Article 293 B of the French General Tax Code, My Spices Land benefits from the VAT exemption scheme and is therefore not subject to VAT. No VAT is charged on products or shipping costs.
My Spices Land reserves the right to change its prices at any time; products are invoiced on the basis of the rates in effect at the time the order is placed.
Promotional offers and tiered pricing for professionals are available upon presentation of proof of status or via the dedicated professional area.
4. Orders and Payment
Orders are placed through the online process on the Site. The customer selects products, adds them to the cart, provides contact details, and chooses a delivery and payment method. Confirming the order constitutes a firm and final commitment.
Accepted payment methods are: credit or debit card (via Stripe), bank transfer, and any other method indicated on the Site. Payment is processed immediately and securely. In the event of non-payment, the order will be cancelled.
5. Delivery
Products are delivered to the address provided by the customer, within mainland France, French overseas territories, and internationally, depending on available zones. Delivery times are expressed in business days and begin from the date payment is confirmed.
My Spices Land makes every reasonable effort to meet the announced delivery times but cannot be held responsible for delays caused by the carrier or by exceptional circumstances (force majeure). Shipping costs are detailed before the order is confirmed.
The customer must check the condition of the products upon delivery and raise any justified concerns within 3 business days.
6. Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the products to exercise the right of withdrawal, without having to give any reason or pay any penalty. Products must be returned in their original condition, complete and unopened (except for opened food items, which cannot be returned for hygiene reasons).
Return shipping costs are the responsibility of the customer. Refunds are issued within 14 days of receiving the returned products, using the same payment method as the original purchase.
The following are excluded from the right of withdrawal: perishable products, and products unsealed after delivery that cannot be returned for hygiene or health protection reasons (in particular loose spices, seeds, etc.).
7. Warranties
All products benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). My Spices Land undertakes to refund or replace defective or non-conforming products after review by our customer service team.
8. Liability
My Spices Land uses all reasonable means to ensure the security of transactions and the quality of the information provided. However, My Spices Land cannot be held liable for failure to perform the contract due to force majeure, an act of the customer, or the interruption of transport or payment services.
9. Intellectual Property
All elements of the Site (text, images, logos, videos) are the exclusive property of My Spices Land or its partners. Any reproduction, representation, or use without authorization is prohibited and constitutes infringement.
10. Personal Data and Cookies
Information collected when placing an order is necessary for managing the customer relationship and fulfilling the contract. In accordance with the French Data Protection Act and the GDPR, the customer has the right to access, rectify, and object to the processing of their data. The Site uses cookies to improve the user experience and generate visitor statistics. The customer can manage cookie preferences via browser settings.
11. Governing Law and Disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. The customer may make use of conventional mediation or the European Commission Online Dispute Resolution (ODR) platform. Failing an amicable agreement, the competent courts shall be those within the jurisdiction of the Nice Court of Appeal.
